Terms of Use
Acceptance of these terms
By creating an account, accessing, or using this application (the "App"), you ("Client") acknowledge that you have read, understood, and agree to be bound by these Terms of Use and the Privacy Policy below. Your use of the App constitutes your acceptance of, and consent to, all terms of these policies, which apply to and bind all Clients. If you do not agree, do not use the App.
Eligibility (minimum age 15)
The App is available to individuals 15 years of age and older. By using the App you represent that you are at least 15. Use of the App by any Client is undertaken with the Client's implied consent that these policies expressly apply to and bind that Client. All Clients are subject to all terms of these policies.
Not medical advice
The App and all content, tools, calculators, and plans provided through it are for general educational and informational purposes only and do not constitute medical, nutritional, psychological, or other professional advice, diagnosis, or treatment, and are not a substitute for the advice of a qualified physician or licensed healthcare provider. Clients are strongly recommended to consult a licensed medical professional before beginning any nutrition, diet, exercise, or training program offered or tracked through the App. Calculators (BMI, BMR, RMR, body-fat, body-water and related metrics) produce estimates that may not reflect your actual health status; individual results vary and no outcome is promised or guaranteed.
Medical emergencies; duty to disclose; assumption of risk
The App is not intended for medical emergencies. If you experience chest pain, difficulty breathing, severe dizziness, injury, or any other medical emergency, stop immediately and call your local emergency number (911 in the United States) or seek immediate medical attention.
You agree to promptly notify your coach of any medical condition, injury, symptom, medication, allergy, pregnancy, or other health circumstance that may affect your safe participation — both before beginning and as any such circumstance arises. A Client's failure to disclose such information, or to follow medical guidance, constitutes the Client's knowing and voluntary assumption of all associated risks and liability, and releases Altitude Fitness LLC and its coaches from any liability arising from information the Client failed to provide. Physical exercise and dietary change carry inherent risks, including injury; you knowingly and voluntarily assume all such risks.
Limitation of liability; strict liability
The App is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, Altitude Fitness LLC, its owners, employees, and coaches shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any injury, loss, or damages arising from your use of or reliance on the App or its content. To the maximum extent permitted by law, you waive, and Altitude Fitness LLC disclaims, any claim sounding in strict liability, and our aggregate liability (if any) shall not exceed the total fees you paid for the App in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not permit certain limitations, so portions of this section may not apply to you.
Acceptable use
You agree to provide accurate information, keep your login credentials confidential, use the App only for its intended coaching purposes, and not attempt to disrupt or gain unauthorized access to the service.
Subscriptions & payments
Premium features are billed on a recurring basis through our payment processor, Stripe, and auto-renew each period until you cancel. You may cancel at any time; access continues until the end of the current paid period. Fees already paid are non-refundable except where required by law. We never receive or store your full card details. Certain items — including genetic tests and their add-ons — are one-time purchases rather than subscriptions, and shipping fees may apply as disclosed at checkout.
Genetic testing (Nutrigenomix)
Genetic and nutrigenomic tests offered through the App are performed by Nutrigenomix Inc., an independent third-party laboratory, and are made available to eligible Clients for a one-time fee plus any selected add-ons and shipping, as shown at checkout. When you purchase a test, you authorize Altitude Fitness LLC to submit the information necessary to place and fulfill your order with Nutrigenomix, to receive your results on your behalf, and you authorize your coach to access and discuss those results with you.
Test results are for educational and informational purposes only, are not a diagnosis, and do not constitute medical advice. They describe genetic tendencies and are only one of many factors affecting your health; they may be incomplete, may not apply to your individual circumstances, and their accuracy, completeness, and turnaround time are determined by the laboratory and are not guaranteed by Altitude Fitness LLC. Pharmacogenetic results, which relate to how your body may process medications, must be reviewed with a licensed physician or pharmacist. Do not start, stop, or change any medication, dosage, or course of treatment based on any result obtained through the App without first consulting your prescribing healthcare provider.
You are responsible for collecting and returning your sample in accordance with the laboratory's instructions. Because a test order causes the laboratory to incur costs and begin work on your behalf, fees for genetic tests, add-ons, booklets, and shipping are non-refundable once your order has been submitted to the laboratory, except where required by law. Prices shown do not include sales, use, or similar taxes; applicable taxes will be added where required by law and are your responsibility. Genetic testing may not be available in all jurisdictions, and you are responsible for ensuring it is lawful where you reside.
Coaching consultations
Certain plans include scheduled one-on-one consultations with your coach. Consultations are coaching sessions for general fitness and nutrition guidance only and, like the rest of the App, are not medical care and not a substitute for advice from a licensed professional. Sessions must be booked in advance, are subject to your coach's availability and confirmation, and may be rescheduled or canceled as described in the App. Unused monthly consultation allowances do not roll over.
Messaging
In-App messaging is provided so you can communicate with your coach about your coaching. It is not monitored continuously, is not for emergencies, and is not a channel for medical advice; responses are not guaranteed within any particular time. Do not use messaging to report a medical emergency — call your local emergency number instead. You agree not to send unlawful, harassing, or infringing content, and you acknowledge that messages are stored and are visible to your coach and authorized administrators.
Third-party services
The App relies on third-party services, including Stripe (payment processing), Cloudflare (hosting and data storage), Nutrigenomix (laboratory testing), Apple Health (optional data import you choose to initiate), and the Open Food Facts database (barcode food lookups). Information returned by such services — including food and nutrition data obtained from barcode scans — may be inaccurate or incomplete, and Altitude Fitness LLC is not responsible for the content, accuracy, or availability of third-party services. Your use of those services may also be governed by their own terms.
No guarantee of results
We make no guarantee, representation, or warranty regarding the success of any program, plan, or service provided through the App. Results vary from person to person and depend on many factors beyond our control, including your own effort, adherence, genetics, and health. No specific result or outcome is promised or guaranteed.
Governing law & dispute resolution
These policies, and any dispute or claim arising out of or relating to them or to the App, are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-laws principles.
Notice & informal resolution. Before filing any claim, you agree to first send written notice describing the dispute to support@altitudefitlife.com and to attempt in good faith to resolve it informally for at least thirty (30) days after that notice is sent.
Venue. If a dispute is not resolved, you and Altitude Fitness LLC agree that it shall be brought exclusively in the state or federal courts located in the State of New Jersey, and each party consents to the personal jurisdiction and venue of those courts and waives any objection to them.
Jury-trial & class-action waivers. To the fullest extent permitted by law, you and Altitude Fitness LLC each waive any right to a trial by jury, and agree that any claim may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Time to bring claims. Any claim arising out of or relating to these policies or the App must be filed within one (1) year after the claim arose; otherwise it is permanently barred, to the extent permitted by law.
Prevailing party. In any action or proceeding brought to enforce these policies, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs.
Changes to these terms
We may update these policies from time to time; your continued use of the App after an update constitutes acceptance of the revised policies.
Privacy Policy
Controller & scope
Altitude Fitness LLC is the data controller responsible for your information under this Privacy Policy.
Information we collect
Account data (name, email, and a password stored using one-way hashing); health & fitness data — age, date of birth, height, weight, body-composition readings, measurements, goals, meal plans, meal and barcode-scanned food logs, vitamin and mineral logs, and check-in history ("Fitness Data"), some of which may constitute health-related or "special category" data; consultation records (sessions you book and related notes); messages you exchange with your coach through the App; if you purchase testing, your genetic-test orders and the genetic and nutrigenomic results returned by the laboratory ("Genetic Data"); payment data (processed by Stripe — we do not receive or store your full card number); and technical data (an essential session cookie that keeps you signed in).
How we store your data
Your data is stored in a secured cloud database hosted by Cloudflare. Access is limited to your coach and authorized administrators. Passwords are hashed and never visible to us or your coach. We use service providers to operate the App, including Cloudflare (hosting), Stripe (payments), and Nutrigenomix (laboratory testing), each of which processes only the data needed for its function. We retain your data while your account is active and as needed to provide the service or comply with legal obligations; you may request deletion as described below.
Genetic & pharmacogenetic data
If you purchase testing, we process your Genetic Data solely to place your order, deliver your results, and let your coach discuss them with you. Genetic Data (including pharmacogenetic data) is sensitive "special category" information that we process only with your explicit consent, which you may withdraw at any time. To fulfill an order we share the information necessary to place it with Nutrigenomix Inc., the testing laboratory, which processes your sample and data under its own privacy terms. We do not sell your Genetic Data or your health-related Fitness Data, and we do not share either for third-party marketing, under any circumstances. We retain Genetic Data only as long as needed to provide the service or as required by law, and you may request its deletion as described below.
How we use and share your data — including marketing
We use your information to provide and improve the coaching service, manage your subscription, and communicate with you. We may also use your contact and account information for our own marketing, and — subject to the consent rules below — collect, store, and sell information we obtain to third parties for marketing and related purposes. By signing up, you consent to the collection, storage, and sale of your information for these purposes, unless you opt out. You may opt out at any time by emailing support@altitudefitlife.com or using the opt-out control in your settings; opting out stops future sales and third-party marketing sharing but does not affect processing needed to provide the service.
Sensitive data & minors — opt-in required. Notwithstanding the above, we do not sell, or share for third-party marketing, any health-related Fitness Data, or any information of Clients under 16, without that Client's (and, for a minor, a parent's or guardian's) express opt-in consent. Your Genetic Data (including pharmacogenetic data) is never sold or shared for third-party marketing under any circumstances, regardless of consent.
GDPR (individuals in the EEA and UK)
If you are located in the European Economic Area or the United Kingdom, the following applies and, to the extent of any conflict, overrides the general terms above:
Legal bases: performance of your coaching contract; your consent (for health-related Fitness Data and for marketing); and our legitimate interests in operating and improving the service. Special category data: we process your health-related Fitness Data and your Genetic Data only on the basis of your explicit consent, which you may withdraw at any time. Your rights: access, rectification, erasure ("right to be forgotten"), restriction, data portability, objection (including to direct marketing), and withdrawal of consent, without affecting the lawfulness of prior processing. International transfers: where we transfer data outside the EEA/UK, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses. Complaints: you may lodge a complaint with your local data protection supervisory authority.
Your choices & deletion
You may request access to, correction of, or deletion of your data, opt out of sale/marketing, or close your account by contacting your coach or support@altitudefitlife.com. Closing your account removes your stored personal data from the active database, subject to any legal retention obligations.

Disclaimer
Estimates for planning and education only
Every figure this App produces — calorie and macronutrient targets, body-composition readings, scores, projections, trends and meal or training suggestions — is an estimate generated for planning and education. Estimates are calculated from the information you and your coach enter and from general population formulas. They are not measurements of your body, not a clinical assessment, and not a prediction of what will happen to you.
Not medical advice; no professional relationship
Nothing in this App is medical, nursing, psychological, dietetic or other licensed professional advice, and nothing in it creates a doctor-patient, dietitian-client or other professional relationship between you and Altitude Fitness LLC. Your coach is a fitness professional, not your clinician. Do not use this App to diagnose or treat any condition.
Talk to a qualified professional first
Speak with a physician or other qualified healthcare provider before you begin, change or stop any nutrition, exercise, supplement or weight-management programme — in particular if you are pregnant or nursing, are under medical supervision, take prescription medication, or have or suspect any medical condition. If a professional's advice conflicts with anything shown here, follow the professional.
Emergencies
This App is not monitored for emergencies and messages are not read in real time. If you believe you are experiencing a medical emergency, call your local emergency number or go to the nearest emergency department. Do not use this App to seek urgent help.
Results vary
No result is promised or guaranteed. Outcomes depend on factors outside this App's knowledge and outside Altitude's control, including your health, genetics, adherence, sleep, stress and circumstances. Anything describing another person's result is that person's experience, not a representation of yours.
Your decisions remain yours
You are responsible for deciding whether and how to act on anything this App shows you, and for the consequences of doing so. The Terms of Use above, including their limitations of liability and assumption of risk, apply in full to this Disclaimer.
